The short version
Onyx is software you rent monthly to run your floor-coating business. Your data stays yours. Pay on time, don't misuse it, and you can cancel whenever you want.
1. Who we are
Onyx ("we," "us") is operated by [Your Company Legal Name]. By creating an account or using Onyx, you agree to these terms. If you're agreeing for a company, you're confirming you're allowed to.
2. Your account
Keep your login details safe and don't share your account. You're responsible for what happens under your account and for everyone you invite to it.
3. Free trial & payment
Paid plans are billed in advance every month through Stripe, our payment processor. If you start a free trial, it turns into a paid plan when the trial ends unless you cancel first. You can cancel anytime — you'll keep access until the end of the period you already paid for. We don't give refunds for partial months unless the law requires it.
4. Your data is yours
The customers, jobs, photos, and financial information you put into Onyx belong to you. We only use it to run the service for you. You're responsible for making sure your data is accurate.
5. Texting and emailing your customers
Onyx can send texts and emails to your customers on your behalf. You are responsible for having permission to contact those people and for following the laws that apply to you (for example, TCPA and CAN-SPAM in the U.S.). Don't use Onyx to send spam or unwanted messages.
6. Fair use
Don't use Onyx to break the law, infringe someone's rights, try to reach another company's data, or interfere with the service. We can suspend or close accounts that do.
7. The service is provided "as is"
We work hard to keep Onyx reliable, but we can't promise it will never have problems. To the fullest extent the law allows, our total responsibility to you is limited to the amount you paid us in the last 12 months, and we aren't liable for indirect or consequential losses.
8. Ending the agreement
You can stop using Onyx and cancel anytime. We can end or suspend access if you break these terms or don't pay. You can export your data before you go.
9. Changes
We may update these terms as the product grows. If we make a meaningful change, we'll let you know. Using Onyx after a change means you accept it.
10. Governing law
These terms are governed by the laws of the State of [Your State], without regard to conflict-of-law rules.
